What is a Building Information Certificate?
The purpose of this certificate is to receive assurance from your council that your building complies with all relevant legislation and standards.
Building Information Certificates are usually sought by buyers or sellers of a property to make sure that a particular building and its land can remain as is without regulatory action being taken by Council. The certificate can apply for whole or part of a building and is valid for seven years.
Illegal Building
Where illegal building works are identified, Council will:
1) Issue the owner with penalty infringement notices; and
2) Issue a “Stop Work” notice where illegal building works continue to be built.
3) Offer owners either the option of demolishing the illegal works or submitting a S96 application for a current Development Application, to modify the consent or a Building Information Certificate application.
4) Illegal building works which constitute major breaches will be prosecuted through either the local Court or the Land and Environment Court. If illegal building work is observed by Council that is under the control of a Private Certifier, the Private Certifier will be given the opportunity to respond to the illegal building works. Should the response be deemed inadequate, Council may report the Private Certifier to The Building Professionals Board.
